GENERAL RENTAL CONDITIONS
Article 1 – THE DRIVER
The driver must hold a category B driving license or its international equivalent, which must be at least two (2) years old, and must be at least twenty-three (23) years of age.
Article 2 – PRICE AND DURATION
This contract begins at the time of signing.
The parties agree on a rental price based on a 24-hour period.
A 45-minute grace period is allowed; beyond that, additional fees will be charged in case of delay:
- Up to 3 hours of delay: The hourly rate will apply
- Beyond 3 hours of delay: The daily rate will apply
The duration of the contract is specified in the "Particular Conditions," and any extension will be explicitly mentioned in an addendum with the sole consent of TEA TAHITI Rent. However, the early return of the vehicle before the end of this contract will not entitle the renter to any compensation, refund, or cancellation fee.
Any return of the vehicle to a location different from the departure station will result in an additional charge of 3,000 XPF.
Fuel, expenses due to a flat tire, provision of spare keys at the renter’s request, fines, penalties, towing fees, tires, punctures, bursts, tears, bent rims, partially or fully destroyed accessories, including seat burns, lost vehicle keys, keys wet from swimming, bottom body damage, and any expenses incurred due to vehicle immobilization, etc., are not included in our rates.
Article 3 – VEHICLE CONDITION
3.1 – Pickup: The renter acknowledges that the rented vehicle is in perfect condition regarding cleanliness and functionality.
If any defect is noticed after the vehicle pickup, the renter must immediately inform TEA TAHITI Rent. Failure to do so may result in the renter being held responsible for damages caused by the defect. An expert may be sent to assess the damages.
The renter is responsible for all accessories and removable parts of the vehicle at the time of delivery. Any destruction or loss of accessories, whether intentional or due to negligence, will be the sole responsibility of the renter.
3.2 – Fuel: The vehicle must be returned with the same amount of fuel as at the time of pickup. Excess fuel will not be refunded. If the fuel gauge is lower than when the vehicle was picked up, the difference will be charged at the current rate of TEA TAHITI Rent.
3.3 – Weekly Technical Check: The renter agrees to return the vehicle to the departure station for a weekly technical check of up to 45 minutes.
If this check exceeds 45 minutes, TEA TAHITI Rent will replace the vehicle with one of the same category or higher, depending on availability. Failure to complete this technical check will result in the renter being held responsible for any vehicle failures causing damage to TEA TAHITI Rent.
Article 4 – VEHICLE USE
The rented vehicle is authorized to travel ONLY on public and private roads open to vehicular traffic on the islands of Tahiti and Moorea.
The renter agrees not to use the vehicle on difficult roads such as the Maroto Valley Road, Mont Marau, or any other roads unsuitable for rental vehicles. Only 4x4 vehicles are authorized to travel on certain unpaved roads, and only if those roads are open to the public.
The use of the vehicle for illegal purposes, such as committing crimes, theft, trafficking, or any other unlawful activity, is strictly prohibited. In case of violation, the renter will be fully responsible, including if the insurance coverage is withdrawn.
Any violation will result in financial penalties and charging of all associated fees.
Article 5 – ACCIDENT – MANAGEMENT
Any accident causing damage to the vehicle must be reported with an insurance report, a form of which is available in the glove compartment. The renter must immediately inform TEA TAHITI Rent to prepare an accident report, unless the renter is hospitalized or detained by law enforcement. In such cases, the renter must present themselves after their release from the hospital or detention.
If an accident report is not presented, a penalty fee of 45,000 XPF will be charged, even if optional insurance coverage has been purchased.
Management fees of 3,000 XPF will apply for the opening of each claim file.
Article 6 – INSURANCE – WARRANTIES
A comprehensive insurance policy with a deductible is included in the rental price.
The renter can opt for the SCDW or SCDW Plus options, for an additional daily fee, to reduce the deductible.
- SCDW Option: Covers damages to the body, glass breakage, and flat tires, but excludes damages to tires caused intentionally or by negligence, as well as damages under the vehicle.
- SCDW Plus Option: Also covers tires and rims.
All terms and conditions of the insurance coverage are available at the rental office.
These optional warranties are subject to compliance with the general rental conditions.
Article 7 – DEPOSIT – RESPONSIBILITY
The renter is fully responsible for any act as defined by Article 1384 of the Civil Code. The renter also acts as a joint guarantor for any damage caused to TEA TAHITI Rent by the second driver specified in the particular conditions of this contract.
The renter agrees to pay a deposit at the time of vehicle pickup. The amount of the deposit varies depending on the type of vehicle rented and will be specified during the reservation or in the contract's particular conditions. This deposit guarantees any potential damages or fees not covered by insurance, as well as compliance with the contract terms.
The deposit will be refunded to the renter within 10 to 15 days after the vehicle is returned, provided no damages are found, and all contract conditions have been met. If any fees need to be deducted, they will be detailed and communicated to the renter.
Article 8 – ADDITIONAL CHARGES
TEA TAHITI Rent reserves the right to charge additional fees within thirty (30) days after the end of this contract. These fees may include:
- The billing of the deductible in case of non-payment upon return of the vehicle and/or in the event of an accident. The amount of the deductible is set according to the general and specific insurance conditions and is already specified in the contract.
- The billing of repair fees for damages that were not visible or hidden at the time of vehicle return, caused by the renter, if these damages are proven or acknowledged by the renter.
- Billing for unpaid fees at the time of vehicle return.
- Full billing for damages and immobilization of the vehicle caused by improper use according to Article 4 of this contract.
- Billing for a thorough vehicle inspection if, at return, additional damage is found beyond its initial condition, or if the condition report was not performed optimally.
- Billing for any illicit use of the vehicle (traffic, theft, crimes, illegal use): all costs related to the consequences of such use will be borne by the renter, including but not limited to, vehicle recovery costs, damages not covered by insurance, fines, and a flat penalty fee.
- Cancellation of insurance coverage due to a serious violation: the renter will be held fully responsible for all material and bodily damages caused.
- Intervention by law enforcement leading to vehicle immobilization or seizure: all fees for recovery and loss of income will be fully charged to the renter.
Article 9 – TERMINATION OF THE CONTRACT
In case of non-compliance with the provisions of Articles 2 and 4, this contract will be automatically terminated, and the return of the vehicle will be required.
Following the termination of the rental contract, insurance coverage will be cancelled.
Article 10 – PENALTY CLAUSE
In the event of non-compliance with the clauses of this contract, any criminal, civil infraction, or any act detrimental to public order and causing harm to TEA TAHITI Rent, the renter will be required to pay an amount equal to the daily rental rate increased by twenty percent (20%) multiplied by the number of rental days under this contract.
The renter acknowledges having read and accepted these terms, and understands that any violation may lead to legal action, which may be pursued after an unsuccessful formal notice.
Article 11 – JURISDICTION
Any dispute related to this contract will be brought before the Court of First Instance in Papeete.
